AnyPeople is an AI-powered platform that generates images using artificial intelligence technology. By using the Service, you acknowledge and understand that:
Fictional Persons Disclaimer: Unless explicitly stated otherwise, persons depicted in AI-generated content are fictional and are not intended to represent or depict any real individual.
Inputs: You retain ownership of the prompts, reference images, and other inputs you provide to generate content ("Inputs"). By using the Service, you grant us a limited license to process your Inputs solely for the purpose of providing the Service.
Outputs — Paid Subscribers: If you are on a paid subscription plan, as between you and AnyPeople, and subject to your compliance with these Terms, ownership of all intellectual property rights in any content you generate using the Service ("Outputs") will vest in you upon creation. To the extent that any such rights do not automatically vest in you by operation of law, we hereby assign our right, title, and interest in such Outputs to you. Due to the nature of AI technology, Outputs may not be unique, and other users may receive similar results. Your ownership does not extend to other users' Outputs.
Outputs — Creator Partners: If you participate in the AnyPeople Creator Program or have entered into a separate creator agreement with us ("Creator Partner"), ownership and licensing of your Outputs will be governed by the terms of that agreement. In the event of any conflict between these Terms and your creator agreement, your creator agreement shall prevail with respect to ownership and licensing of Outputs.
Outputs — Free Users: If you are using the Service under a free plan and are not a Creator Partner, as between you and AnyPeople, ownership of all intellectual property rights in any Outputs will vest in AnyPeople upon creation. To the extent that any such rights do not automatically vest in us by operation of law, you hereby assign your right, title, and interest in such Outputs to us. We grant you a limited, non-exclusive, non-transferable, revocable license to use, download, and commercialize your Outputs.
Public Content: When you make your Outputs publicly available through the Service (for example, by publishing to the gallery), you grant AnyPeople a perpetual, non-exclusive, worldwide, royalty-free, sublicensable, and transferable license to use, reproduce, modify, distribute, publicly display, and create derivative works from the visual Output for the purpose of operating, improving, and promoting the Service, including training and enhancing AI models.
Generation Metadata: The prompts, settings, parameters, and other generation information associated with your Outputs ("Generation Metadata") remain subject to your ownership of Inputs as described above. Where the Service offers features enabling you to monetize access to Generation Metadata, you retain control over such metadata, and AnyPeople's license to Generation Metadata is limited to operating and displaying the Service (including previews, thumbnails, or summaries necessary for the marketplace to function). AnyPeople will not disclose your full Generation Metadata to other users without your consent or applicable payment through the Service.
Private Content: For Outputs that you do not make publicly available, you grant AnyPeople a non-exclusive, worldwide, royalty-free, non-sublicensable, and non-transferable license to use such content for the purpose of providing, maintaining, and improving the Service, including training and enhancing AI models.
Gallery Content: Images made publicly available by other users through the gallery are licensed to all users of the Service for personal and commercial use, subject to the Prohibited Uses below. This license does not extend to the Generation Metadata associated with such images, which may be subject to separate access terms as described in Section 5.

Creator Features: The Service may offer features that allow eligible users to monetize their content, including charging credits for access to Generation Metadata or other content ("Creator Features"). Creator Features are available exclusively to Paid Subscribers and Creator Partners.
Creator Program: AnyPeople may offer a Creator Program that allows selected individuals to access Creator Features and publish content to the Service under separately negotiated terms ("Creator Partner Agreement"). Creator Partners may include, but are not limited to, artists, influencers, and content creators invited or approved by AnyPeople. Participation in the Creator Program is subject to a separate Creator Partner Agreement and is granted at AnyPeople's sole discretion.
Credits and Revenue: Credits earned through Creator Features are subject to the credit terms and policies set out on the Service. AnyPeople reserves the right to set and modify platform fees, minimum pricing, credit conversion rates, and other terms governing Creator Features transactions.
Content Standards: Content offered through Creator Features must comply with all provisions of these Terms, including Prohibited Conduct. We may remove content from Creator Features, suspend access to Creator Features, or terminate Creator Program participation at our sole discretion.
The Service may allow users to upload or provide reference images for the purpose of generating AI content.

Violations of this section may result in immediate suspension or termination of your account.
Fees: Certain features of the Service require payment of fees. You agree to pay all applicable fees associated with your use of the Service.
Payment Processing: Payments are processed through third-party payment processors. By providing payment information, you authorize us and our payment processors to charge the applicable fees to your designated payment method.
Refund Policy: All fees are non-refundable unless otherwise specified. We may, at our sole discretion, provide refunds or credits in specific circumstances.
Price Changes: We reserve the right to modify our fees and billing methods at any time upon reasonable notice to you.
Service Changes: If we discontinue a paid feature or service during your active subscription period, we will make commercially reasonable efforts to provide a substantially similar alternative. If no suitable alternative is available, we will issue a pro-rata refund of prepaid fees for the remaining portion of your subscription period.
Company Property: The Service, including its original content, features, functionality, design, and underlying technology, is and shall remain the exclusive property of AnyPeople and its licensors. The Service is protected by copyright, trademark, and other intellectual property laws.
User Content: You retain ownership of the prompts and inputs you provide to generate content. Ownership of generated Outputs is governed by Section 4 of these Terms.
Feedback: Any feedback, suggestions, or ideas you provide regarding the Service shall become our exclusive property. You hereby assign all rights in such feedback to us and acknowledge that we may use it without compensation or attribution.
We respect intellectual property rights and respond to notices of alleged infringement in accordance with the Digital Millennium Copyright Act (DMCA).

You may be held liable for damages resulting from materially false or bad-faith claims.
Repeat Infringer Policy: In accordance with the DMCA and other applicable law, AnyPeople maintains a policy of terminating, in appropriate circumstances and at our sole discretion, the accounts of users who are deemed to be repeat infringers. We may also, at our sole discretion, limit access to the Service or terminate the account of any user who infringes the intellectual property rights of others, whether or not there has been any repeat infringement.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECTS WILL BE CORRECTED.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL ANYPEOPLE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.
You agree to indemnify, defend, and hold harmless AnyPeople and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
Termination by You: You may terminate your account at any time by discontinuing use of the Service or by contacting us.
Termination by Us: We may suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice, at our sole discretion.
Effect of Termination: Upon termination, your right to access and use the Service ceases immediately. Sections 4, 7 through 14, and 17 of these Terms shall survive termination.
You may not assign, transfer, or delegate these Terms or any of your rights or obligations hereunder without our prior written consent. Any attempted assignment in violation of this section shall be null and void.
We may freely assign, transfer, or delegate these Terms and our rights and obligations without restriction or notice.
We reserve the right to modify these Terms at any time. Material changes will be communicated through notice on the Service or via email to registered users.
Your continued use of the Service following the posting of modified Terms constitutes your acceptance of such changes. If you do not agree to the modified Terms, you must discontinue use of the Service.
Dispute Resolution: Before initiating any legal proceeding relating to these Terms or the Service, you agree to first contact us at support@anypeople.ai and attempt to resolve the dispute informally for at least thirty (30) days. If the dispute is not resolved within that period, either party may proceed with legal action in accordance with the Governing Law provision below.
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to conflict of law principles.
Entire Agreement: These Terms, together with the Privacy Policy and License, constitute the entire agreement between you and AnyPeople regarding the Service and supersede all prior agreements and understandings.
Severability: If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.
Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
Third-Party Links: The Service may contain links to third-party websites or services. We are not responsible for the content, policies, or practices of any third-party sites.
